Billboard broke the story<\/a> of the Elvis lawsuit against Anthropic. According to its report, the complaint says Claude’s maker infringed 274 copyrighted Presley songs, including “Can’t Help Falling in Love”, “A Little Less Conversation” and “Don’t Be Cruel”. It also names “All Shook Up”, “Return to Sender” and “(You’re The) Devil in Disguise”.<\/p>\n\n\n\n A unit of Authentic Brands Group filed it. That is the licensing giant that largely controls the Elvis intellectual property: much of the song catalogue, the brand trademarks and the rights to his name, image and likeness. Other companies that own Elvis rights co-filed. The legal tracker ChatGPT Is Eating the World posted the complaint<\/a> under the name ABG EPE IP LLC v. Anthropic.<\/p>\n\n\n\n Labels and publishers have sued AI companies plenty of times. Still, Billboard calls this by far the most high-profile legal action filed on behalf of an individual musician. Anthropic had not commented on the Elvis lawsuit when Billboard published.<\/p>\n\n\n\n Richard Busch is the lead attorney, and the complaint accuses Anthropic of building its whole business on infringement “at a scale never seen before”. That phrase sounds familiar because it is. Reservoir’s complaint against Suno, filed by Busch’s team two days earlier, uses the same line about a business model built on infringement. Lawyers reuse good samples too (presumably cleared, since it is their own loop). Anyway.<\/p>\n\n\n\n This detail is easy to miss. Claude writes text, while Suno makes audio. So when Round Hill sued both companies in August, Forbes<\/a> noted that the Anthropic suit was narrower: it covered lyrics and compositions, not recordings, because Claude is a text model rather than an audio generator.<\/p>\n\n\n\n Reservoir’s case followed the same pattern. It alleges that Anthropic copied the lyrics of 853 of its compositions to train Claude without permission. It also claims Claude produces copies of those lyrics, and works derived from them, when users ask.<\/p>\n\n\n\n Early reports on the Elvis lawsuit don’t say exactly which rights it asserts against Anthropic. Billboard does say it mirrors the earlier cases, claiming the company used music en masse to build technology that produces “unlicensed derivative works”. So expect lyrics and compositions to be at the centre, and the famous voice to stay out of it. For now.<\/p>\n\n\n\n With the Elvis lawsuit added, Anthropic’s music litigation now needs a table of contents. We tried keeping a spreadsheet. It now needs a spreadsheet of its own.<\/p>\n\n\n\n According to the tracker, the Elvis lawsuit is the 8th AI music copyright suit the law firm Adams & Reese has filed this year, and the 157th suit against AI companies in its running count. But the name is the biggest. Juries know who Elvis is. Most of them have never heard of ABKCO.<\/p>\n\n\n\n The money is easy to calculate in the abstract. Under US law, rights holders can seek statutory damages of up to $150,000 per work wilfully infringed. Multiply that by 274 songs and the theoretical ceiling is about $41.1 million. That is our arithmetic, since early reports on the Elvis lawsuit don’t give the figure the complaint asks Anthropic to pay.<\/p>\n\n\n\n The bigger issue sits underneath all of these cases. AI companies argue that training is fair use, and Billboard notes that the question is still open in dozens of lawsuits, with billions of dollars riding on it. Every tool you use to write, score or caption something depends on the answer: what it costs, and whether it still exists next year.<\/p>\n\n\n\n Look at how Busch’s complaints are built. They lean hard on where the data came from, and less on what training does to it. That is deliberate. Forbes points out that in 2025 Judge William Alsup ruled in the Anthropic books case that training on copyrighted text could count as fair use, while storing millions of pirated books in a permanent library did not.<\/p>\n\n\n\n So even if training wins, the way the data was collected can still lose. Every new catalogue becomes a new complaint, asking the same question with a different song list. The Elvis lawsuit brings no new legal theory against Anthropic. Instead it brings a face everyone recognises, and in a public argument that counts for something.<\/p>\n\n\n\n Our honest read (from people who are not lawyers and say so): no single ruling will end this. The answers will come one decision at a time, maybe one settlement at a time, while new filings keep arriving at roughly one a week.<\/p>\n\n\n\n First, find out what your AI tools say about their training data. If the terms of service avoid the topic, that tells you something. Then keep your licence records next to the project files, because “the AI made it” doesn’t count as paperwork.<\/p>\n\n\n\n Also check tracks before you upload them rather than after. In Mubert’s own data from the last 28 days, about one in four results from our copyright checker found a rights holder’s claim on the uploaded track (25.9%, down slightly from 27.2%). Those were tracks people were about to publish.<\/p>\n\n\n\n If you build products on top of language models, watch for the ruling from the October 21 hearing. Whatever happens to the Elvis lawsuit, that decision will tell Anthropic and everyone else more than any new complaint.<\/p>\n\n\n\n One of the 274 songs is “Return to Sender”.
