Universal Music Group, Concord and ABKCO sued Anthropic over lyrics used to train its Claude chatbot. That Anthropic lyrics lawsuit has now had its fair use hearing, and the judge has not ruled yet. Yes, really. (Fair use is the part of US copyright law that lets you use protected work without permission in some cases.) If you make music, videos or apps with AI tools, the ruling could change what those tools cost, what their terms allow and how hard their filters clamp down on what you type into them. Both have asked for summary judgment. That means a ruling on the written record, with no trial, unless the judge finds facts a jury must settle. No jury. No witnesses. Yet.

The publishers’ claim is simple. According to MediaPost, they say Anthropic trained Claude to hand users copies of lyrics on request. So this hearing is the main event of the Anthropic lyrics lawsuit. It isn’t some procedural side show.

Update, October 22: the hearing ran all day on October 21, and Judge Lee ended it without a ruling. She took the motions under submission and gave no hint of her view, Courthouse News reports. No date for a decision was set. According to Bloomberg Law, she spent most of her questions on market harm and pressed both sides to help her decide whether this becomes the first AI copyright case to go to trial.

For the publishers, Matthew Oppenheim argued that Claude reproduces lyrics, sometimes word for word, and that its new songs dilute the market for human ones. “It couldn’t do it if it didn’t have the lyrics in the database,” he said. Anthropic’s lawyer Sonal Mehta answered that users are the ones pushing the button and that “there isn’t anything in the record that shows doom for the music industry.” MLex adds that the publishers called the use not transformative whether Claude copies lyrics, remixes them or writes new songs.

Lee asked whether the publishers’ position would hand them a monopoly over lyrics, so that nobody could write in an existing style without a licence. Law360 reports she seemed open to Anthropic’s fair use defense and said AI “mash-up” lyrics might be fair use.

The420 says the songs include tracks linked to Beyoncé, The Rolling Stones and The Beach Boys. The publishers also say Claude produced near-identical lyrics to “What a Wonderful World”, “Gimme Shelter” and “American Pie”. Users only had to ask.

What happened so far in the Anthropic lyrics lawsuit

October 2023: UMG, Concord and ABKCO file the Anthropic lyrics lawsuit in Nashville. Later, the case moves to Northern California (MediaPost).

Early 2025: Anthropic agrees to keep guardrails that stop Claude from serving infringing lyrics (The Hollywood Reporter).

March 2025: Lee denies the publishers a preliminary injunction. She calls fair use for AI training “an open question” (Music Ally).

2025: Lee dismisses all but one claim, but lets the publishers refile. They do (Music Business Worldwide).

2026: Both sides ask for summary judgment.

August 2026: The publishing arms of Sony Music and Warner Music file their own suit against Anthropic (The Spokesman-Review).

October 21, 2026: Lee hears the fair use arguments in a daylong hearing and takes the motions under submission, with no ruling yet (The News).

Concord also has a second case running alongside this one. In it, according to The Epoch Times, Concord alleges that Anthropic trained Claude on pirated copies of 20,517 music works taken from torrent sites. That number is oddly specific, which is usually how you know a lawyer counted it.

Both sides read the fair use factors differently

Judges weigh a few questions in a fair use case. Why was the work used? How much was copied? Does the new use hurt the market for the original? In the Anthropic lyrics lawsuit, each side has picked its favourite question.

The publishers picked market harm. They say Anthropic used their lyrics but skipped the licence fees that lyric services pay. According to Reuters, they argue that Claude’s answers compete with licensed lyrics and water that market down. The market is real. Companies already pay to show song lyrics on their sites and in their apps, which gives the publishers a price tag to point at when they say something was taken.

Anthropic picked purpose. As the company sees it, training a model is a different act from reposting a lyric. In that view, the lyrics are one small slice of a huge dataset that teaches Claude how language works, and the model was never built to stand in for a lyrics site. Anthropic also warns that requiring a licence for every training input would make large-scale training close to impossible. Every single one.

Lyrics are an odd thing to license anyway. You pay for the words of a song you already paid for, shown on a page full of ads. We have read more lyric licence terms than we’d like to admit, usually at night, usually because something just got muted, and they do not get more romantic with age.

Anyway.

Two judges already disagreed on AI training

Judge Lee has precedent to read, but the precedent argues with itself. Two other judges have ruled on AI training. They split.

In the authors’ case against Anthropic, Judge William Alsup found that training gave the books a new purpose. That counts toward fair use. Still, he faulted Anthropic for keeping pirated books in a central library it didn’t need for training. The authors’ case still ended with Anthropic paying $1.5 billion to settle, which is a lot of money to spend on a case where the judge mostly agreed with you about training.

Judge Vince Chhabria, hearing a case against Meta, struck a different tone and warned that AI could flood creative markets and cut the value of human work.

So the Anthropic lyrics lawsuit will probably turn on market harm. Lee raised this herself in 2025. Back then, she said the publishers were asking her to map out a licensing market for AI training before anyone had settled whether fair use applies.

Why the Anthropic lyrics lawsuit matters to creators

This case is about a chatbot, not a song generator. Still, the rule it sets will reach both. Courts don’t sort by file type. Reuters notes that it’s one of dozens of similar cases against OpenAI, Meta, Google and others, so Lee’s reasoning in the Anthropic lyrics lawsuit could echo through every one of them.

If fair use wins broadly, AI firms keep training on big datasets without licensing every work. If it loses, training costs more and licensing deals come first.

For you, that shows up in three places. Your AI tools’ prices. Their terms. How strict their output filters get. Music generators already have their own court fights (see what Suno shipped while its lawsuit runs). Musicians want a say too, as the AFM’s Human Made, Human Paid campaign shows.

For most creators, copyright isn’t a theory. It’s a notification. About one in four tracks run through our copyright checker came back with a rights holder’s claim. That share is down slightly from the month before (Mubert’s own data, last 28 days).

What we think: outputs are the easy part

Whatever the judge decides on training, the output question is nearly settled. Anthropic agreed to guardrails. Nobody seriously defends a chatbot that recites “American Pie” in full on request.

Training is harder. We don’t expect a clean answer, because a win for Anthropic would just sit next to Alsup and a win for the publishers would sit next to Chhabria, and neither cancels the other. The420 notes the ruling may not settle the question nationwide, though it could still become a major precedent. Then the appeals start. Everyone keeps billing by the hour.

Our bias, stated plainly: we generate music from samples that artists upload and get paid for. So we think paying for the input works as a business. We’d know. Where training data came from is becoming a product feature, whether AI companies like it or not.

What to do before Judge Lee rules

Until the Anthropic lyrics lawsuit gets a ruling, read the terms of every AI tool you publish with. Look for two things: what it says about training data, and who owns the output. If a chatbot hands you a full verse of a famous song, keep it out of anything public. Even as a joke. Then save your generation records and licences somewhere you’ll find them in a year.

After that, wait. The courtroom in San Jose still has no speakers. The first thing this case releases will be a long written opinion, and it won’t have a chorus.

UMG, Concord and ABKCO and Anthropic are making their fair use arguments over song lyrics used to train Claude.
