This post is for YouTubers, TikTokers, small brands and anyone editing a spooky reel this month who wants free or royalty-free tracks without a claim in their inbox in November. It covers what “free”, “royalty-free” and “public domain” actually allow and where the traps sit on YouTube and TikTok. Then it ends with a checklist you can work through this week.

It goes the same way every year. Somebody films a lovely pumpkin-carving video and drops in an organ toccata from a “free classical music” upload. Then the scariest sound of the season turns out to be the Content ID notification. (Content ID is YouTube’s automatic system: rights holders send in reference files, it matches uploads against them, and the owners can take the ad money, track the video or block it.)

Halloween music is a licence problem dressed up as a taste problem

Picking the mood is easy. Minor key, plucked strings, a church organ, maybe a theremin if you are feeling retro. Anyone can hear what sounds spooky in about four seconds, which is why so much Halloween music online sounds roughly alike.

The hard part is knowing who owns the file. Spooky music is especially sneaky here, because so much of it is old. People assume old means free. Sometimes it does. Often it means “old tune, new recording, very much owned by someone”.

We learned this the slow way. One of us once scored a short Halloween promo with a recording of Danse Macabre from a channel that had the word “free” in its name twice. Saint-Saëns died in 1921. The orchestra on that recording did not, and neither did its label. The claim arrived before the video had a hundred views.

So this post judges every source of Halloween music by its paperwork. Taste is your department.

Free and royalty-free are two different promises

People use these words as if they meant the same thing. They don’t.

“Free” means you don’t pay money. It says nothing about what you may do with the file. A song can cost nothing to download and still forbid ads, edits or use outside one platform, and plenty of free Halloween music sits on pages with exactly those limits, three scrolls below the download button.

“Royalty-free” means you don’t owe a payment every time someone plays the video. You might pay once. Or nothing. Still, the licence sets the rules: which platforms, which kinds of commercial use, and if you owe anyone a credit. Royalty-free is a payment model. It doesn’t promise that nobody will ever claim your video.

“Public domain” is the only one of the three where the copyright has actually expired. Nobody owns it. So nobody can license it to you or take it away. That sounds perfect, which is why the next section exists.

We wrote about the gap between paying for a licence and proving you have one in our post on podcast music claims. The same logic applies to a costume haul on YouTube.

Public domain Halloween music: old notes, new owners

Every piece of recorded music carries two separate rights. One covers the composition, meaning the notes and lyrics as written, and the other covers the sound recording, one particular performance captured on one particular day. They expire on different schedules.

In the US, the 2026 Public Domain Day reporting set out both dates clearly. NPR explained that musical compositions from 1930 entered the public domain this year, while for recordings the cut-off is 1925. The Discography of American Historical Recordings at UC Santa Barbara confirms that all recordings published in 1925 entered the public domain on January 1, 2026. That is US law. Other countries count differently, so check the rules where you and your audience live.

So the classic catalogue of Halloween music is free at the composition level. Danse Macabre, In the Hall of the Mountain King, Night on Bald Mountain, the Toccata and Fugue in D minor: all four date from the 1800s or earlier. You can perform them, arrange them or play them on a kazoo in a cape.

(A quick tangent. The Toccata and Fugue in D minor, the most Halloween-sounding piece ever written, may not even be by Bach. Scholars have argued about its authorship for decades, and it has kept haunting the world without needing to know who wrote it. Anyway.)

Most recordings of those pieces are a different story. A 2015 orchestral recording of Danse Macabre is a 2015 sound recording. It has an owner and very possibly a Content ID reference. Copyright Lately’s Public Domain Day explainer makes the same point with a pop example: a 1925 recording of a song enters the public domain, while a 1962 version of the same song keeps its copyright much longer.

Where public domain recordings actually live

There are two honest routes to public domain Halloween music. The first is genuinely old recordings. UCSB says it has digitised more than 2,800 recordings from 1925 and plans to make them downloadable. Most are jazz, blues and dance bands. Not horror scores. But crackly 1920s audio already sounds like a haunted ballroom, which is half the job done.

The second route is new recordings that musicians release on purpose under open terms. Musopen is a nonprofit that records and shares public domain classical music, and it is the first place we would look for a Danse Macabre with no label attached. Licences vary per recording, though. Read the one attached to your file, not the one you think the site uses.

Content ID and public domain disputes

YouTube’s own rules are on your side here, up to a point. Its Content ID eligibility page lists public domain recordings and compositions, and Creative Commons content, as ineligible for use as references. So if someone claims a truly public domain recording, the claim is wrong.

Wrong claims still happen. Then you dispute them. YouTube’s dispute help page suggests you read up on public domain first. It also lists reasons that don’t count as valid grounds, including crediting the copyright owner and choosing not to monetise the video. If you do dispute, the claimant has 30 days to respond before the claim expires.

Keep a note of where your Halloween music came from and its year. That note is your whole case.

The YouTube Audio Library is the easiest free option inside YouTube

If your Halloween video lives only on YouTube, the YouTube Audio Library is the first free stop for music. It is a collection of production music and sound effects. It lives in YouTube Studio. Nowhere else.

YouTube says Content ID won’t claim music and sound effects you download from the library. Some tracks carry a Creative Commons licence, and for those you must credit the artist in the video description. Studio has a button that copies the attribution text for you. There is also an “Attribution not required” filter for when you can’t be bothered, which in late October is always.

The catch isn’t legal. Everyone else digs through the same library for Halloween music too, so the same handful of eerie tracks will play under a lot of haunted-house tours this month. Your viewers might not notice. Your comment section will. And since YouTube built the library for YouTube, read the licence before you take the file anywhere else.

TikTok splits its Halloween music by account type

TikTok has two lanes for Halloween music, and your account type decides which one you are in. According to TikTok’s Commercial Music Library help page, the Commercial Music Library is a global catalogue of 1 million songs that helps businesses find music for their content.

A Business Account sees only those “Commercial Sounds” when it taps Add Sound. A personal account sees all sounds and can switch to Commercial Sounds from a dropdown. It also filters by region. So a track available for a campaign in one country may not show up in another.

In practice, if you run a costume shop, a bakery selling ghost cookies or anything else that sends invoices, the trending Halloween music in your feed is probably not yours to use. Use the commercial lane, or bring music you have properly licensed elsewhere. If you are a person filming your cat in a bat costume, the rules are friendlier. Your cat may disagree.

Creative Commons tracks come with homework

Creative Commons, or CC, is a set of standard licences that creators attach to their own work so other people can reuse it without asking first. Each licence combines a few conditions. The CC licence overview spells them out: BY means you must credit the creator, NC limits you to noncommercial uses, and SA means you share any adaptation under the same terms.

Credit is more than a name. The licence deed asks for appropriate credit, a link to the licence and a note if you changed anything. Put all three in the description. It takes ten seconds.

NonCommercial is where it gets murky. CC defines it as use not “primarily intended for or directed toward commercial advantage or monetary compensation”. Then the CC FAQ says plainly that CC cannot advise you on what counts as commercial use. Thanks, CC. A monetised channel, a sponsored video or a brand page could land on either side. If you are unsure, the FAQ suggests asking the rights holder or picking work that allows commercial use. We’d pick the second. Rights holders answer email in March.

Then there is NoDerivatives, the funniest clause in this whole post. The CC 4.0 legal code says a music track always becomes Adapted Material once you sync it “in timed relation with a moving image”. And the BY-ND legal code lets you make adapted material but not share it.

Put a NoDerivatives song under your video and you have made something you may watch alone, in your room, by candlelight. Posting it is another matter. For Halloween music, that is almost poetic. For your upload schedule, it is a dead end.

Famous Halloween songs are the riskiest music you can pick

The songs everyone associates with October are commercial hits. Labels and publishers own them. They have licensed them many times over, and they are exactly the sort of catalogue Content ID was built to protect. Recordings from the 1950s onwards will not reach the US public domain for decades.

So a recognisable Halloween anthem under your video is not “free music you happen to know”. It needs permission. On most platforms that permission doesn’t come with an upload button. The platform might let a personal user post it, then share any ad money with the owner, or mute it, or block it in some countries. Every outcome belongs to someone else.

Sound-alikes and covers help less than people hope. A cover is a new recording of a composition someone else still owns. Re-recording the famous riff yourself with a synth and a confident attitude doesn’t change who wrote it.

If you want a broader comparison of where creator music comes from, our guide to AI music vs stock libraries sets the options side by side.

Halloween music under a voiceover should sit low and stay simple

Licences aside, a lot of spooky tracks fail for a boring reason. They are too busy. Horror scores love high strings, sudden stabs and huge swells, which works in a cinema and falls apart under someone explaining how to carve a pumpkin.

If your video has talking in it, pick Halloween music with space in the middle: low drones, sparse plucks, a slow pulse. Keep it well below the voice, then bring it up in the gaps between lines. Save the jump-scare sting for the one moment that earns it. Use it twice and it becomes a doorbell.

Same with effects. A creaking door. One crow. A distant bell. Layer six of them at once and your cosy autumn vlog starts sounding like a theme park queue.

Pacing matters too. Cuts that land on the beat feel deliberate, while cuts that land just after it feel nervous, and not in the fun way. We wrote a whole post on matching music to video pacing if you want the long version.

Custom Halloween tracks fit the video, not the other way round

There is a second, quieter problem with free tracks: length. Your Short runs 47 seconds. The track runs three minutes. So you either fade it out mid-phrase or cut your video to the song, and we have covered both bad options at length in how to make music fit your video length.

This is where generated Halloween music is worth a look. With Mubert Render you describe a mood, genre, tempo or the video itself, and get an original track of the exact length you need. The platform builds it from samples that real artists upload and get paid for, so the result isn’t a copy of a track already sitting under a thousand other videos. The platform licence covers commercial use, but the exact scope depends on your plan. Check it. Check the live pricing page too, before a client project.

And to be fair to the other side: it won’t be Danse Macabre. If your video needs the actual Saint-Saëns, find a properly public domain or CC0 recording and keep a note of where it came from. If it needs “slow creeping strings, 47 seconds, ends on a sting”, there is no reason to chop a three-minute file and hope.

A checklist for Halloween music this week

The goal is simple. The only jump scare in your video should be the one you edited in, not the one waiting in YouTube Studio.

List every piece of Halloween music in your October videos, with the source, the licence type and the year next to each one.

Check the recording date, not the composer’s.

Filter the YouTube Audio Library by “Attribution not required”, or copy the CC credit into the description.

Switch TikTok brand posts to Commercial Sounds.

Drop every NoDerivatives track from your videos, because syncing music to moving images counts as an adaptation under CC 4.0 and you may not share it.

Swap out famous Halloween hits.

Generate or edit music to your video’s exact length instead of fading out a three-minute file.

Save licence screenshots in the project folder, so a dispute takes five minutes, not five evenings.

Spooky music is easy to find and surprisingly easy to get claimed for.
